Restaurant Sued After Doctor Reports Injuries from Spicy Dish 

A California Thai restaurant is facing a spicy dish lawsuit after a San Jose neurologist claimed that she suffered severe internal injuries from an appetizer described as “dangerously spicy.” 

As per reports, the woman ordered a chicken meatball dish called Dragon Balls at Coup de Thai in Los Gatos in July 2021. The appetizer was prepared using Thai bird’s eye chili, one of the world’s hottest peppers. Since the customer had an intolerance to spicy foods, she asked for a milder version of the dish. However, despite her request, she alleges that the dish was served without modification.  

Just shortly after eating, she began coughing and felt burning sensations “like fire” throughout her nasal passage and mouth. As per medical records, chemical burns to her vocal cords, esophagus, and the inside of her right nostril can be seen.  

The Lawsuit 

The spicy dish lawsuit itself was filed in 2023, and it seeks compensation for medical bills, lost wages, and other damages. The case is set for trial on August 25, after a judge denied a joint request for delay.  

A representative from the restaurant stated that the Dragon Balls cannot be made less spicy due to the way they are prepared. They also noted that no other customers have reported similar injuries. 

Food-Related Legal Battles 

Even though it’s quite unusual, lawsuits over food-related injuries are not unprecedented. Over the years, cases involving burns, allergic reactions, and foodborne illness have drawn national attention. 

  • In 1994, a jury awarded $2.8 million in the famous McDonald’s hot coffee case after a customer was burned by spilled coffee. 
  • In 2023, another lawsuit was filed against McDonald’s after an 85-year-old woman suffered burns from a coffee lid that was allegedly not secured properly. 
  • A Texas barbecue restaurant was also sued this year after a customer sustained second-degree burns when a container of barbecue sauce was served too hot to handle. 

The outcome of this spicy dish lawsuit could draw further attention to how restaurants prepare and communicate spice levels and ingredients. It also serves as a reminder of how quickly a dining experience can turn into a legal battle.
